1. Who we are and what these terms cover
FreshLinen is a digital welcome book service for short-term rental properties, operated by FreshLinen, an assumed business name of Fresh Linen Digital LLC (“FreshLinen,” “we,” “us”). These Terms of Use are a binding agreement between you and Fresh Linen Digital LLC. They apply to property owners and managers who subscribe to FreshLinen (“Hosts”) and to anyone who views a guidebook published through FreshLinen (“Guests”). By creating an account, subscribing, or using a guidebook, you agree to these terms.
2. The service
FreshLinen lets Hosts create digital guidebooks for their rental properties: arrival instructions, wifi details, house rules, local recommendations, appliance guides, and similar hospitality information. Guests access guidebooks through a link or QR code. No Guest account is required. Some guidebook pages may be saved to a Guest’s device so they remain available without an internet connection.
3. Host accounts
- You must be at least 18 years old to create a Host account.
- You are responsible for the accuracy of your account information and for keeping your password secure. Activity under your account is your responsibility.
- You may only create guidebooks for properties you own or are authorized to manage.
4. Subscriptions and billing
- Building a guidebook is free. An active subscription, billed annually, is required to publish a guidebook to guests and to generate QR codes. There is no free tier for published guidebooks.
- Payments are processed by Stripe. We never see or store your card details. Your subscription renews automatically each year until you cancel.
- You can cancel at any time through the billing portal in your dashboard. Cancellation takes effect at the end of the paid period, and your guidebooks remain live until then.
- Except where the law requires otherwise, fees are non-refundable.
- If we change pricing, the new price applies at your next renewal and we will notify you at least 30 days in advance.
- If a renewal payment fails, we may suspend access to your dashboard and guidebooks until payment is resolved.
5. Host content and responsibility
Hosts own the content they put in their guidebooks. By publishing a guidebook you grant FreshLinen a license to host, store, display, and cache that content as needed to operate the service.
Hosts are solely responsible for their guidebook content. That includes, in particular:
- The accuracy of access information such as door codes, and updating it when it changes.
- The accuracy and completeness of safety-related information, such as property boundaries, swimming areas, and appliance instructions. FreshLinen displays this information but does not verify it.
- Having the rights to any text and images uploaded to a guidebook.
- Not publishing content that is unlawful, deceptive, infringing, or harmful.
6. Guest use
Guidebook content is provided by the Host, not by FreshLinen. We do not inspect properties and cannot verify that any information in a guidebook is accurate or safe to rely on. Physical safety decisions, such as where to swim or how to operate equipment, are between you and your Host. If information in a guidebook looks wrong, contact your Host.
Searches you type into a guidebook are recorded and shared with that guidebook’s Host so they can improve their information. Search queries are not linked to your name or identity. See the Privacy Policy for details.
7. Acceptable use
- Do not use the service for any unlawful purpose.
- Do not attempt to access other Hosts’ accounts or data, probe or disrupt the service, or circumvent access controls.
- Do not scrape, copy, or republish the service or its guidebooks at scale, and do not resell the service without our written permission.
8. Our property
The FreshLinen platform, software, design, and brand are the property of Fresh Linen Digital LLC and are protected by intellectual property laws. These terms do not grant you any rights in them apart from the right to use the service.
9. Termination
Hosts can stop using FreshLinen at any time by canceling their subscription. We may suspend or terminate accounts that violate these terms, create risk for us or for others, or fail to pay. If we terminate your account without cause, we will refund the unused portion of your current subscription period.
10. Disclaimers
The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that offline copies of guidebook pages will always be current, or that Host-provided content is accurate.
11. Limitation of liability
To the fullest extent permitted by law, Fresh Linen Digital LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or 100 US dollars if you have paid us nothing.
12. Indemnification
Hosts agree to defend and hold harmless Fresh Linen Digital LLC from claims arising out of their guidebook content or their breach of these terms, including claims by Guests relying on information a Host published.
13. Governing law and disputes
These terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in Illinois, and both parties consent to their jurisdiction.
14. Changes to these terms
We may update these terms from time to time. If a change is material, we will notify Hosts by email or through the dashboard before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.
